April 2022: The MDL Paraquat class action judge will have a status conference on April 1st to review where the litigation is headed and how best to take the bellwether lawsuits forward for trial in November 2022. 44 new paraquat lawsuits have been added to the MDL in the last two weeks. At this pace, April 2022 will be the busiest month for new files yet. Last week, the parties filed their class-action bellwether picks with the Paraquat MDL judge. Those choices, however, have not been made public.

May 2022: In the last month, over 50 new cases have been added to the Paraquat Lawsuit Multidistrict Litigation (MDL). A group of six patients was recently selected by the Paraquat MDL court for the initial Paraquat Parkinson's disease bellwether trials. As a result, the first trial in November 2022 is approaching soon. The strategy is to select 16 paraquat claims from among the almost 1000 Parkinson's disease litigation claims filed. Following some limited fact discovery in these instances, paraquat attorneys on both sides submitted a preference list to the MDL court, ranking the 16 cases in order of priority. Attorneys for plaintiffs seek the finest facts for their clients, while defense attorneys want the worst. The judge whittled the list down to six Paraquat claims based on these rankings.

The Los Angeles Unified School District has reached a $3.55 million settlement in the cases of two additional victims of Mark Berndt, a former Miramonte Elementary School teacher convicted of sexually abusing children and charged with committing lewd acts against 23 boys and girls, ages 7 to 10. More charges may be coming, as five more alleged victims have stepped forward. The claims accused Mr. Berndt of sexual harassment, abuse, and molestation of the victims from around 2004 through 2008. Berndt pleaded no contest in 2013 to 23 charges of lewd conduct upon a child and was sentenced to 25 years in prison.

Berndt forced his pupils to participate in a blindfolded "tasting game" in his classroom. It was said that the "game" involved feeding children cookies containing bodily fluids. In addition, Berndt recorded images of his alleged mistreatment of children. Some of the images show children being gagged with tape, while another features youngsters with cockroaches crawling all over their faces. After developing the photos, a watchful employee at a pharmacy photo lab discovered the unsettling images and gave them to the police. About 400 images were taken by investigators from Berndt's residence and the photo lab. The newly settled cases claimed that the Miramonte administration and LAUSD officials ignored multiple complaints dating back to the early 1980s. 

In 2014, the LAUSD paid a record $140 million to 81 victims and about $30 million to the families of 65 Miramonte students. These settlements are another chapter in a scandal, highlighting the ongoing problem when officials choose to overlook red flags and complaints of a serial sexual predator within the LAUSD.
